GAINS Gym Liability Waiver

LIABILITY WAIVER AND RELEASE AGREEMENT

In consideration of my participation in any exercise or fitness activities at Gains In Bulk LLC headquarters gym, and premises,, located at 8150 E Germann Rd, Suite 115, Mesa, AZ 85212 (the "Gym"), I, the undersigned, acknowledge and agree to the following:

1.) Assumption of Risk:

I acknowledge that participation in physical exercise, strength training, and conditioning activities involves inherent risks, including but not limited to bodily injury, heart attack, stroke, paralysis, and even death. I voluntarily assume full responsibility for any risks, injuries, or damages, known or unknown, which I might incur as a result of participating in activities at the Gym. I understand that these risks include, but are not limited to, injuries that may result from equipment malfunction, improper use, negligent actions of other participants, or my physical condition.

2.) Medical Consultation and Responsibility:

I acknowledge that it is my sole responsibility to consult with a medical professional before engaging in any exercise or fitness activities. I hereby confirm that I am physically and mentally fit to participate in the activities provided by the Gym, and I have no medical condition that would prevent my participation. I agree that I will not participate if I am aware of any medical condition that could be aggravated by exercise.

3.) Waiver and Release:

I, on behalf of myself, my heirs, assigns, personal representatives, and next of kin, hereby release and hold harmless the following parties from any liability, claims, demands, or causes of action that may arise as a result of my participation in the Gym’s activities, including any claim arising from negligence, personal injury, property damage, or wrongful death:

Gains In Bulk LLC (Lessee)

Greenwood & McKenzie Real Estate Investments (Building Ownership)

Chamberlain Enterprises (Property Mangement)

Braven Grant and Shelby Grant

Gains In Bulk LLC and its employees, agents, representatives, and contractors

This release applies to all claims, actions, and demands of any kind that I may have now or in the future, whether caused by the negligence of the released parties or otherwise.

4.) Indemnification:

I agree to indemnify, defend, and hold harmless Gains In Bulk LLC, Braven Grant, Shelby Grant, Building Onwership, Property Management, and all other released parties from any claims, lawsuits, costs, damages, or expenses (including attorney's fees) arising in connection with my participation in the activities at the Gains In Bulk headquarters gym,, including any claims brought by third parties arising from my actions.

5.) Voluntary Participation:

I understand that my participation in any physical activities at the Gains In Bulk is entirely voluntary and that I may withdraw from participation at any time. I understand and acknowledge the risks involved and willingly choose to participate.

6.) Severability:

If any part of this waiver is deemed unenforceable by law, the enforceability of the remaining provisions will not be affected, and the remaining terms will remain in full force and effect.

By signing this waiver, I acknowledge that I have read, understood, and agree to be bound by its terms. I confirm that I am at least 18 years of age, or if under 18, I have obtained the consent of a parent or legal guardian.
